Jaipur, the capital of Rajasthan, is a world centre for coloured gemstones and jewellery, known also for hand-block printed textiles from Sanganer and Bagru, blue pottery, and a tourism economy built on its forts and palaces. In a market this crowded, the same or a similar name is very likely to exist already — which makes the search before filing as important as the filing itself.

For applicants in Jaipur our team works remotely — search first, an honest opinion on the chances, then filing and every reply the Registry asks for.

Serving businesses in Jaipur online. Our team works from Noida, Uttar Pradesh — we do not run a branch in Jaipur. Documents are shared over WhatsApp or email and every filing is made on the official government portal.

How a trademark is registered for a business in Jaipur

In Jaipur the difficult part of registration is clearance, not paperwork. With lakhs of marks on the register, a proper search covers identical, phonetically similar and visually similar marks across related classes, and grades the risk before any fee is paid. Filing follows in Form TM-A — ₹4,500 a class for individuals, start-ups and small enterprises, ₹9,000 for others — then examination, a four-month opposition window and registration.

Applications from Rajasthan fall under the Ahmedabad office of the Trade Marks Registry. Filing, replies and most hearings are handled online, so the office’s location does not require you to travel — but it is the office that will examine your application and issue notices.

Business names worth protecting in Jaipur

Rajasthan applications are examined at the Ahmedabad office. Jaipur has several registered Geographical Indications — Sanganeri and Bagru hand-block printing and blue pottery among them — which protect the craft collectively. Individual printers, designers and labels build their own brands on top, many selling to boutiques abroad. Jewellery houses, with long family histories, register house marks and collection names.

Block-print labels and designers

Class 24 and 25 for the label; the craft name stays shared.

Jewellery houses

Class 14, with the family name’s ownership agreed.

Exporters to boutiques abroad

Protection in the main buyer countries.

Classes and cautions, by type of business

Craft & Regional-Product Sellers. Craft sellers usually work under three layers of naming: the craft or place name, which may be a Geographical Indication; the artisan’s or family’s own name; and, increasingly, an online store name. Only the last two can be owned. Producers in a GI area can apply to be recorded as authorised users, which lets them use the GI lawfully and act against imitations sold under it.

Garment & Textile Businesses. In textiles the name travels on a small piece of cloth or paper — a woven label, a selvedge stamp, a hang-tag — and that is the form in which it should be registered and proved. Print and embroidery designs themselves are not trademarks; they are protected, if at all, by design registration or copyright. Manufacturers who make for other labels should keep their own house mark separate and not reuse a buyer’s artwork.

Exporters. An Indian registration protects the mark only in India. Exporters can extend protection abroad through the Madrid Protocol, filing one international application based on the Indian mark and designating the countries they sell to. The Indian application has to be in place first, and the foreign filing depends on it for the first five years.

What an unregistered name risks

  • Machine-made imitations sold under a craft’s name undercut genuine makers who have no brand of their own to point to.
  • Counterfeiters copy the label first, because buyers check the label and not the stitching.
  • A foreign distributor who registers your brand in their own country can lawfully stop your shipments there.
  • The filing date fixes your priority: a later applicant for a similar mark in the same class will be cited against yours, not the other way round.
  • Marketplaces, distributors and investors increasingly ask for the application number or certificate before they deal with a brand.

How the application moves, step by step

  1. Understanding the brand. We note what you sell, where, and since when — this decides the classes and whether to claim prior use.
  2. Clearance search. Word, phonetic and logo searches are run and the conflicting marks, if any, are shown to you with our view of the risk.
  3. Application. The mark is filed in the applicant’s correct name and category, with a user affidavit where earlier use is claimed.
  4. Follow-through. Examination report, reply, hearing, publication and any opposition are handled as they arise, and you are told at each stage.

Registering a trademark from Jaipur: common questions

No. Sanganeri hand-block printing is a registered Geographical Indication for fabric printed by hand in the traditional manner in that area. Using the name for screen- or machine-printed fabric is an infringement of the GI and misleads buyers.

A producer of the goods in the defined area applies to the Geographical Indications Registry, usually jointly with or with the consent of the registered proprietor of the GI. Once entered as an authorised user, you may use the GI on genuine goods and take action against misuse.

No. A trademark protects the brand name or logo that identifies you. An original print, pattern or garment design is protected by registering it as a design before it is released, or in some cases by copyright. Many textile businesses need both.

No. Trademark rights are territorial. Through the Madrid Protocol you can file a single international application from India designating other member countries, each of which examines the mark under its own law.

If an identical or confusingly similar mark is already registered or applied for in the same field, yours is likely to be objected to or opposed. The search tells us this in advance; sometimes a modified name or a narrower description solves it, and sometimes a new name is the honest advice.

A word mark protects the name in any style and is usually the stronger first filing. A logo registration protects that particular design. If the budget allows only one, we normally suggest the word mark, unless the name is descriptive and the logo is what makes it distinctive.
