Delhi is both the national capital and northern India’s largest trading centre, with wholesale markets such as Chandni Chowk, Sadar Bazar, Khari Baoli, Gandhi Nagar and Nehru Place, industrial areas at Okhla, Narela and Bawana, and a vast services economy. With that many businesses competing in the same categories, an unregistered name is exposed — both to copycats and to an earlier owner turning up with a legal notice.

For applicants in Delhi our team works remotely — search first, an honest opinion on the chances, then filing and every reply the Registry asks for.

How a trademark is registered for a business in Delhi

Registration follows a fixed path: search, application in Form TM-A for the relevant classes, examination, publication for four months and registration. The official fee is ₹4,500 per class for individuals, recognised start-ups and Udyam-registered enterprises and ₹9,000 per class for other applicants. Objections in the examination report must be answered within the time allowed, or the application is treated as abandoned.

Applications from Delhi fall under the New Delhi office of the Trade Marks Registry. Filing, replies and most hearings are handled online, so the office’s location does not require you to travel — but it is the office that will examine your application and issue notices.

Trademarks in Delhi: who files and for what

Delhi applicants file before the New Delhi office of the Trade Marks Registry, and disputes go to the Delhi High Court, which has a dedicated intellectual property division — so this is where much of India’s trademark litigation happens. The city’s own filings come from garment labels of Gandhi Nagar and Karol Bagh, spice and dry-fruit packers of Khari Baoli, electronics and accessory brands, and thousands of online sellers. Wholesale markets are also where lookalike goods appear first.

Class 25, with the label device registered as well as the word.

Spice and dry-fruit packers of Khari Baoli

Class 29 and 30, avoiding descriptive names.

Trademark points for each type of business

Online & D2C Sellers. An online seller can list products without a trademark only as an unbranded or generic item, or as a reseller of someone else’s brand. To sell as a brand — with its own storefront, enhanced content and control over who else may list under it — platforms such as Amazon, Flipkart and Meesho ask for a trademark application or registration, and the name must match the product packaging exactly.

Garment & Textile Businesses. In textiles the name travels on a small piece of cloth or paper — a woven label, a selvedge stamp, a hang-tag — and that is the form in which it should be registered and proved. Print and embroidery designs themselves are not trademarks; they are protected, if at all, by design registration or copyright. Manufacturers who make for other labels should keep their own house mark separate and not reuse a buyer’s artwork.

Food & Agri-Product Brands. On a shelf, a food product is recognised by its packet before its name is read. The label — its colours, layout and picture — can be registered as a device mark, and the artwork is also protected by copyright. Words that only describe the product, such as “pure”, “fresh” or “desi”, are free for every seller to use; the registrable part is the distinctive name or design you add.

Why registering the mark matters

  • Sellers who build reviews on an unprotected listing can lose it to anyone who registers the brand name first.
  • Counterfeiters copy the label first, because buyers check the label and not the stitching.
  • A rival who copies the colours and layout of a known packet takes sales even with a different name.
  • The filing date fixes your priority: a later applicant for a similar mark in the same class will be cited against yours, not the other way round.
  • Marketplaces, distributors and investors increasingly ask for the application number or certificate before they deal with a brand.

From search to certificate: our process

  1. Portfolio check. We list every name, logo and tagline in use and the classes each one touches, so nothing important is left unprotected.
  2. Risk-ranked search. Each mark is searched and graded; weak or conflicting marks are flagged before any fee is paid.
  3. Filing strategy. Word mark first or logo first, single or multi-class, with or without a prior-use claim — decided and filed.
  4. Prosecution and watch. Objections and oppositions are answered on time, and the journal is watched for similar marks filed by others.

Questions about trademark registration in Delhi

With a registered trademark you can seek an injunction and a court-appointed search and seizure of the infringing stock, and file a criminal complaint for counterfeiting. Courts in Delhi grant such orders regularly, but they depend on showing your registration and evidence of the copies.

Yes, but only as a generic listing or as a reseller of existing brands. To register your own brand with the marketplace, protect the listing from hijackers and run brand advertising, a trademark application or registration in the right class is required.

No. A trademark protects the brand name or logo that identifies you. An original print, pattern or garment design is protected by registering it as a design before it is released, or in some cases by copyright. Many textile businesses need both.

Often yes. If the label is registered as a device mark, a deceptively similar get-up infringes it; even without registration, a passing-off action is possible if your packaging has a reputation. Copyright in the artwork gives a further remedy. Evidence of your earlier use is essential.

If an identical or confusingly similar mark is already registered or applied for in the same field, yours is likely to be objected to or opposed. The search tells us this in advance; sometimes a modified name or a narrower description solves it, and sometimes a new name is the honest advice.

A word mark protects the name in any style and is usually the stronger first filing. A logo registration protects that particular design. If the budget allows only one, we normally suggest the word mark, unless the name is descriptive and the logo is what makes it distinctive.
